These Terms of Service ("Terms") govern your use of www.vast-nutrition.com (the "Site") and your purchase of products from Vast Nutrition, LLC ("Vast Nutrition," "we," "us," or "our"), a Pennsylvania limited liability company. By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Shipping Policy.

IMPORTANT: SECTION 18 REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT WITHIN 30 DAYS AS EXPLAINED IN SECTION 18.

1. Use by minors

If you are under 18, you may use the Site and our products only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

2. Health and FDA disclaimer

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. 

Information on the Site, in our emails, on social media, and on product labels is for general information only and is not medical advice. Our products are dietary supplements, not medicine.

Talk to your doctor before using our products, especially if you have diabetes, hypoglycemia, or any other blood sugar condition; are pregnant or nursing; take any medication; have a medical condition; or are under 18. Always read the label and follow the directions. Do not exceed the recommended serving. Stop using the product and contact a doctor if you have any adverse reaction. Check the ingredient list for any allergens before use. Individual results vary.

You are responsible for deciding whether our products are right for you. You use them at your own risk.

3. Products and pricing

We try to describe and display our products accurately, but we do not guarantee that descriptions, images, or other content are error-free. Product colors and packaging may vary.

Prices and availability can change without notice. If a product is listed at the wrong price or with incorrect information, we may cancel any order for it and refund your payment, even after you receive an order confirmation. We may limit or refuse any order, including limiting quantities per customer.

4. Orders and payment

Your order is an offer to buy. We accept it when we ship it. You agree to provide accurate, current information and authorize us to charge your payment method for the order total, including shipping and applicable taxes. We may cancel any order we suspect is fraudulent or violates these Terms.

5. All sales final

All sales are final and non-refundable once an order is placed, except for damaged, defective, or incorrect items as described in our Refund Policy.

6. Shipping and risk of loss

We ship as described in our Shipping Policy. Title and risk of loss pass to you when the carrier marks your order as delivered.

7. Subscriptions

If you sign up for a subscription, you authorize us to automatically charge your payment method on file at the price shown at checkout, plus shipping and taxes, on the delivery schedule you choose, until you cancel. Your subscription renews automatically.

• How to cancel: Cancel anytime online through your account, or by emailing help@vast-nutrition.com. To avoid your next charge, cancel before your next billing date.
• Renewal orders are non-refundable once they are placed, except for damaged, defective, or incorrect items as described in our Refund Policy. Cancelling stops all future orders.
• Price changes: If the price of your subscription changes, we will notify you before the new price applies. You can cancel before your next billing date if you do not accept the change.
• Failed payments: If your payment fails, we may retry the charge, pause, or cancel your subscription.

8. Discount codes and promotions

Only one discount code may be used per order, and codes cannot be combined with other offers unless we say otherwise. Codes have no cash value, cannot be applied to past orders, and cannot be sold or transferred. We may change, end, or refuse any promotion at any time, and we may cancel orders that misuse a code.

9. Loyalty program

Loyalty points have no cash value and cannot be transferred, sold, or exchanged for cash. Points may expire after 12 months of account inactivity. We may cancel points earned through fraud, abuse, or violation of these Terms. We may change or end the loyalty program with notice. Any points remaining when the program ends may be forfeited.

10. Text message (SMS) terms

By opting in to Vast Nutrition text messages, you agree to receive recurring automated marketing and order-related text messages at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help, or email help@vast-nutrition.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

11. Email marketing

If you sign up for marketing emails, you can unsubscribe at any time using the link in any email. We will still send emails about your orders, subscriptions, and account.

12. Accounts

You are responsible for keeping your account login secure and for all activity under your account. Tell us right away if you believe your account has been used without permission.

13. Reviews and content you submit

If you submit reviews, photos, comments, or other content, you give us a free, permanent, worldwide license to use, copy, edit, and display it in connection with our business, including in marketing. You confirm that your content is truthful and that you have the right to share it. We may remove any content at any time, including content that makes medical claims, is misleading, or is offensive.

14. Intellectual property

The Site and its content, including the Vast Nutrition name, logos, text, images, and designs, belong to Vast Nutrition or its licensors. You may not copy, reuse, or distribute them without our written permission.

15. Prohibited uses

You may not use the Site to break any law, buy products for unauthorized resale, commit fraud, interfere with the Site's security or operation, scrape or copy content using automated tools, or impersonate anyone.

16. Disclaimer of warranties

TO THE FULLEST EXTENT ALLOWED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR RESULT FROM USING OUR PRODUCTS. Our products are made by third-party manufacturers using ingredients from third-party suppliers.

17. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, VAST NUTRITION AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY HARM RESULTING FROM MISUSE OF OUR PRODUCTS OR FAILURE TO FOLLOW LABEL DIRECTIONS AND WARNINGS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. Some states do not allow certain limitations, so some of these may not apply to you.

You agree to defend and indemnify Vast Nutrition against any claims, losses, or costs, including reasonable attorneys' fees, arising from your misuse of the Site or our products or your violation of these Terms.

18. Dispute resolution and arbitration

Informal resolution first. Before starting arbitration, you agree to email help@vast-nutrition.com with a description of your claim and try to resolve it with us for at least 30 days.

Binding arbitration. Any dispute arising from these Terms, the Site, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Hearings will take place in Dauphin County, Pennsylvania, or by phone or video, at your choice.

Exceptions. Either party may bring an individual claim in small claims court. Either party may seek a court order to stop infringement of intellectual property.

Class action and jury waiver. YOU AND VAST NUTRITION AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU AND VAST NUTRITION WAIVE THE RIGHT TO A JURY TRIAL.

Opting out. You may opt out of this arbitration agreement by emailing help@vast-nutrition.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your name, address, and email. Opting out does not affect any other part of these Terms. 

If the class action waiver is found unenforceable for a claim, that claim will be decided in court, not arbitration.

19. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules. Any claim not subject to arbitration will be brought in the state or federal courts located in Dauphin County, Pennsylvania.

20. Changes and termination

We may update these Terms at any time by posting the new version on the Site and changing the "Last updated" date. Changes apply to orders placed after they are posted. We may suspend or end your access to the Site if you violate these Terms.

21. General

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and Vast Nutrition. If any part is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. We are not responsible for delays caused by events beyond our control, such as weather, carrier delays, or supply shortages.

This Privacy Policy explains how Vast Nutrition, LLC ("Vast Nutrition," "we," "us," or "our") collects, uses, and shares your personal information when you visit www.vast-nutrition.com (the "Site"), make a purchase, join our loyalty program, or sign up for our emails or text messages. By using the Site, you agree to this Privacy Policy.

1. Who we are

Vast Nutrition, LLC is a Pennsylvania limited liability company located at 1249 Cocoa Ave., Suite 101, Hershey, PA 17033. You can reach us at help@vast-nutrition.com.

2. Information we collect

Information you give us. When you place an order, create an account, subscribe, join our loyalty program, or contact us, we collect your name, email address, phone number, shipping and billing address, order history, subscription preferences, loyalty points, and any messages you send us.

Payment information. Payments are processed by Shopify Payments. We do not see or store your full card number.

Information collected automatically. When you use the Site, we and our partners automatically collect your IP address, approximate location, device and browser type, pages you view, products you look at, how you arrived at the Site, and how you interact with our emails. We collect this using cookies, pixels, and similar technologies.

Information from others. We may receive information about you from Shopify, our marketing and analytics partners, and advertising platforms.

Health information. We do not ask for or intentionally collect health information. Please do not send us details about your medical conditions. If you do, we will use them only to respond to you.

3. How we use your information

We use your information to:

• Process, ship, and track your orders and subscriptions
• Manage your account and loyalty rewards
• Respond to your questions and requests
• Send marketing emails and text messages if you have agreed to receive them 
• Show you ads on other websites and apps, including Meta (Facebook and Instagram) and TikTok
• Understand how people use the Site and improve it
• Prevent fraud and protect the security of the Site
• Comply with the law and enforce our Terms of Service

4. Cookies, pixels, and tracking

We use cookies and pixels, including the Meta Pixel and TikTok Pixel and analytics tools, to remember your cart, measure how the Site performs, and show you relevant ads. You can manage cookies through our cookie banner and your browser settings. We honor Global Privacy Control (GPC) signals as a request to opt out of targeted advertising for that browser.

5. How we share your information

We share personal information only as described here:

• Service providers that help us run our business, including Shopify (our store platform and payment processor), Klaviyo and Shopify Email (email marketing), our text message provider, our loyalty and subscription apps, analytics providers, and shipping carriers (USPS, UPS, and FedEx).
• Advertising partners such as Meta and TikTok, which receive information through their pixels to help us measure and target ads.
• Legal and safety reasons, when required by law or to protect our rights, our customers, or others. 
• Business transfers, if our business is sold, merged, or reorganized.

We do not sell your personal information for money. However, some state laws treat sharing data with advertising partners for targeted ads as a "sale" or "sharing." You can opt out as described in Section 7.

6. Text messages

If you sign up for text messages, we use your phone number to send the messages you agreed to receive. We will not share your mobile number or text message consent with third parties for their own marketing purposes. Reply STOP to any message to unsubscribe.

7. Your choices

• Emails: Click "unsubscribe" at the bottom of any marketing email.
• Texts: Reply STOP to any text message.
• Targeted ads: Use our cookie banner, turn on GPC in your browser, or email help@vast-nutrition.com with the subject "Do Not Sell or Share."
• Account information: Update your details by logging into your account or contacting us.

Even if you opt out of marketing, we will still send messages about your orders and subscriptions.

8. Your state privacy rights

Depending on where you live, including California and other states with consumer privacy laws, you may have the right to:

• Know what personal information we have about you and get a copy of it
• Correct inaccurate information
• Delete your personal information
• Opt out of the sale or sharing of your information and targeted advertising
• Appeal our decision if we deny your request
• Not be treated differently for using these rights

To make a request, email help@vast-nutrition.com with the subject "Privacy Request." We will verify your identity before responding, usually by matching information you give us with our records. You may use an authorized agent, but we may ask for proof that you gave them permission. We will respond within the time required by law, typically 45 days. If we deny your request, you can appeal by replying to our response with the subject "Privacy Appeal."

California residents: In the past 12 months, we have collected identifiers (such as name, email, phone, and address), commercial information (such as purchase history), internet activity (such as browsing and ad interactions), and approximate location. We collect this information for the purposes in Section 3 and share it with the categories of recipients in Section 5.

9. Children's privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has given us information, contact us and we will delete it.

10. How long we keep information

We keep personal information as long as needed to fulfill orders, manage your account and subscriptions, meet tax and legal requirements, resolve disputes, and enforce our agreements.

11. Security

We use reasonable safeguards to protect your information. No website or method of transmission is completely secure, so we cannot guarantee absolute security.

12. Where we operate

We sell only to customers in the United States, and your information is processed in the United States.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date above. Your continued use of the Site after an update means you accept the revised policy.
